Defense of property in South Sacramento

Interesting story from sacramento earlier this week.  Heard it first on the Phil Cowan show, according to him, Tom Sullivan actually paid the man's bail :clap:

I say good for Tom, and I am sorely dissapointed in the results of this event :down:

SACRAMENTO, Calif. -- A south Sacramento man who told police he was defending his property was arrested early Wednesday after shooting a teenager who was allegedly trying to steal his car, authorities said.

Police said 42-year-old Sou Saechin told them he accidentally shot the teen at about 3 a.m. on Rock Creek Way.

But officials said Saechin went too far in trying to protect his red Honda.


"What we try to stress to people is that deadly force, the use of a firearm, is never justified under any circumstances to protect property," said Sgt. Matt Young of the Sacramento Police Department.

Police said Saechin came outside of his home armed with a .22-caliber rifle and confronted three alleged burglars.

Saechin fired one shot, hitting one of the alleged burglars in the chest. The three fled the scene, police said.

Saechin's wife said her husband was not trying to kill anyone but only wanted to warn the robbers.

Saechin was taken to jail on suspicion of assault with a deadly weapon. Bail was set at $30,000.

The injured teenager was taken to Kaiser Permanente Medical Center for treatment and is expected to survive.

Police said they are looking for two other people who were involved in the attempted theft. The men were described as Asian and between 18 and 20 years old.

I'm not much into guns anymore, but I do think you should allowed to shoot to kill if someone is commiting a crime.

I thought, despite it's reputation, California had a "Castle Law". I was surprised to hear that, but I found that out when I was reading about Texas' newly enacted law.

i dont see how he accidentally shot someone in the chest with a rifle...... there is a difference in threaing some punk ass kids and shooting someone in the chest..... do i agree that there is nothing rong with the kids getting shot, yes, however the defense of they were trying to steal my car and i came after them with a gun and accidentally shot one of them in the chest sounds like a load of :pokinit:.....

Other sources have said that it was a warning shot that hit the guy (not kids, 18-20, stealing cars, no longer kids)  and that the hit was an accident, not the shot.  Personally, I don't really care.  Either way, the punk got what he deserved, and should consider himself lucky he is still alive.

That's the crux of the matter. The court system has got to stop "understanding" the criminals and start kicking ass the first time a kid goes wrong.

Myself, I'da plugged all of them in the legs, right after I yelled "look out, they have guns!".  "Honestly officer, I thought I saw 3 thugs with guns stealing my car, I was only protecting myelf!" 

Had this happened in texas, wouldn't the car owner do jail time for not actually killing them?

I guarantee if I EVER find anyone breaking into or attempting to steal anything of mine, I will pull a gun on them without any remorse.

Yes I beleive you should have a right to protect your property but I do not beleive some young kid should get shot I beleive in a good old ass kicking but not MURDER,  The shot should have been below the waist if any.

:nope:  I think this is the idea that ultimately led us to where we are.  Wounds heal, and then they're back to stealing stuff.  I can garantee that if I was one of the other two, and I saw my buddy get shot in the chest (and if it was a larger calibur gun, die)  I would seriously reconsider my choice of occupation.  I believe it is the knowledge that the law is pretty much on their sides if they get caught that has made thieves so bold.

"I felt threatened officer, and one of them had a gun!"  sure the guy you shot is going to say different, but I'm doubting either of his buddies are gonna turn themselves in to back him up.  :dunno:

The  :jail: are so over crowded he in CA that the theives know that if they get caught, the will be released soon cause there is no room for them. Then they just go do it again. There should be harsher punishment for theives. I.E. if you get caught stealing, start by cutting off a finger & go from there. Pretty soon he/she won't have any finger to grab with. What gives anyone the right to take something that doesn't belong to them? I better not catch anyone trying to steal my junk, I work too hard for what I have & there will be heck to pay  :bash:

Part of the problem with this state is that we coddle the criminals and give them more rights than the honest law abiding citizens.  that is Bull Crap!!  :maddest:  And on top of that the Democrats want us to give up our guns.  talk about a crime rate increase.... 
Thieves will just walk in without fear of a gunshot to the chest.

Now matter how tough we all like to think that we are, your chances of issuing an Ass kicking at 3am against 3 possibly METH'ed up kids is very slim.  The ass kickings should have been taken care of when they were 12 and 15 by there father.

I hold parents responcible for not disciplining their kids, people are getting too careless with parental responcibilities. You know how many 3 year old kids I see walking the streets without a parent insight?   barefoot... little girls without shirts on.... candy smeered all over their face at 7 in the morning. It's absolutely ridiculous...the things that parents let their kids get away with, your just raising another criminal.

I firmly believe that at some point, the militia that is spoken of in the second amendment will be needed to contol the crime on our streets rather than its inital intended purpose of keeping government in check. The problem now is obviously complex, and we on this board are not going to solve the problem, but rather, we need to make sure we don't loose the right to defend ourselves against those who do not follow by the same set of morals.

There are many "problems" which contribute to the overall decline in our society. I'd like to blame it all on the bleeding heart liberals, but unfortunatly, there is plenty of blame to go around. I do agree that first and formost, it is the parents responsibility to raise their children with respect for others rights and property. However we also need to have a balanced and FAIR legal system that adequatly punishes those who step over the line, and teach them the lessons that their parents failed to teach.

I could go on and on about this, as I'm fairly opinionated on this subject, but I don't want to bore everyone and completley wear out my keyboard.

Personally, just to keep this on topic, I think the kid got what he deserved, and I think the PD stepped over the line by arresting the property owner. I shudder to think what will happen in the civil courts after all the criminal stuff is over.

The Sacramento District Attorney's office will not prosecute the man who police said shot a 17-year-old boy breaking into his car last week, officials announced Wednesday morning.

Sou Saechin, 42, was acting in self defense because the boy reached into his sweatshirt and appeared to step toward Saechin, who feared "he was about to be attacked," according to a news release issued by the district attorney's office.

Saechin had confronted the boy and his two alleged accomplices outside his south Sacramento home April 4 after hearing a noise, police said. The boys were trying to break into Saechin's Honda Civic, police said.

Although Saechin then broke the law by firing three shots at the boy and his two alleged accomplices in a car as they tried to get away, authorities will not prosecute Saechin because "no one was injured by the unlawful shots he fired as the car drove away," according to the release.

Saechin said in an interview from his home Wednesday he didn't "think it was wrong to mark the car."

The father of four added he "didn't understand" why he was arrested and that he "did right to protect my family and my property."

Prosecutors added that Saechin's testimony also will be needed against the three alleged burglars and "it is not legally practical" to prosecute both cases.

Authorities will prosecute the alleged burglars -- Marco Virelas, Larry Tran and the 17-year-old boy, whose name is not being released because he is a juvenile.

"Our decision not to prosecute the person who fired shots is based on these specific facts," the release stated. "Here, the balance weighs in favor of prosecuting the burglars and not Mr. Saechin."

The release added "that deadly force is only permitted when necessary to protect oneself or others from death or great bodily injury."
