This guy, Shwab, was trying to have his death sentence repealed (is that the right word?) because of a glitch with a prior death sentence by a lethal injection gone temporarily awry.
Saying that Lethal Injection in cruel and inhumane.

Umm.. yeah... I would much rather be a young innocent boy put to death by rape and murder... that is MUCH more humane!!!!!!!!!!!  and not at all cruel!!!!!!!!!!!!!

State Supreme Court upholds lethal-injection procedures

Florida's procedure for carrying out execution by lethal injection doesn't conflict with the U.S. Constitution's ban on cruel and unusual punishment, the state Supreme Court unanimously ruled today.

The ruling may clear the way for the execution scheduled this month of Mark Dean Schwab, one of two inmates who have challenged the way Florida administers lethal injections to condemned prisoners.

The issue is also under review, however, by the U.S. Supreme Court, which is considering a similar issue in a case from Kentucky. That court has allowed only one execution to be carried out since it agreed to hear the Kentucky case.

Schwab, 38, is scheduled to die Nov. 15 for the rape and murder of 11-year-old Junny Rios-Martinez, of Cocoa.

The court ruled in Schwab's case, and in another case brought by another condemned man, Ian Deco Lightbourne, that Florida's procedure doesn't violate the Constitution, particularly since extra safeguards were put in place after problems in another execution. In that procedure, it took 34 minutes -- twice as long as usual -- for convicted killer Angel Diaz to die.

It boggles my mind that someone could commit such a horrendous crime and still feel that he should be treated humanely, or actually not be put to death (which is of course the reason for these pleas)
How can they live with themselves? Oh.. that's right.. it's not their fault.. they were a victim.. some victim of some wrong done to them.. so then that makes it all OK... everyone is a victim... it's all our fault...

Everyone who has ever had surgery and been under general anesthesia has undergone the first step in a lethal injection execution. I've have always found it a rather pleasant experience, yet the lawyers have said this might be painful...BULL. Every time I gone under it was peaceful and I could've listened to some Pink Floyd.

I'm no longer a violent kind of guy...but, I would volunteer to put one or two between his eyes from point blank range. A .45 frangible would be quick and (unfortunately) painless. I'd offer a money back guarantee with the job...I'd also want the condemned to be aware and be able to look me in the eye just before pureeing his brain.

That is what I am talking about.. some of the best times in my life have been being put under. They nothing but fortunate not to have the eye for an eye imposed on them.

I think we could save a lot of money and educate the public about the dangers of certain wild predators at the same time. They just need to build a giant alligator pit with an attached shark tank and then get people involved by letting everyone vote whether they should be fed to the sharks, or the gators. Maybe they could turn it into a reality show, and each season add another deadly predator. That would be must see TV.


Really though, that scumbag thinks a nice peaceful lapse of consciousness into death is cruel and unusual? I would take that over life in prison. Personaly though I would rather see this guy tossed in the shark tank.  :twocents:

I also think the crime would go down across the board if we really put the smack down. I mean common someone murders someone  else and the worst that happens is they sit around and watch tv? Some countrys do some pretty rough things to people who are just petty crooks, I think we ( U.S. Government) should open our eyes and see the system doesnt always work

A local man here recently molested his 1 year old son multiple times. In court he claimed it was an "accident" and got a plea bargin for 6 months in jail and 6 years probation. Another guy a few years back raped his own daughter and son and only spent 8 months in jail for it. What the hell is that about? If I saw the guy walking down the street I would beat either of down on the spot. Mere months for torturing children and scarring them for life? The justice system is fucked for sure.

Did they actually change the wording to read "cruel and inhumane" instead of the long standing "cruel and unusual"?

He's been in jail for many years, on death row. He's up for execution so he has to have been there at least 8-10 years.

I guess the article does say 'cruel and unusual' but that's the way they've been saying it on the radio. 'cruel and inhuman' (not inhumane)

Why is it that the criminals are the ones with all the rights? It is a perversion of the intended punishment system that has led to this, and all the bleeding heart liberals! Crime would most certainly go way down if the criminal had to consider loosing his life for his activity. Personally, I think that once you've crossed the line and are a convicted felon, you have lost all your rights. If you can't play by the rules that society has accepted, then you don't get to enjoy the rights that come with it.

This idiot certainly did not think about how cruel or inhumane he was being to the poor kid who was his victim. What makes him think he deserves anything better? This is just a last ditch effort to try and save his bacon, which if I were in charge, would just make his punishment worse.
