This Is Our Justice System At Its Best

This will be two stories both are true and very recent events handled by the Riverside County Courts. It really drives home how screwed up our systems thinking is.

Incident 1:

A boy 15 years old that loves to skate board is at a local skate park, he is with a group of his friends having fun doing what kids do at a skate park. As with all kids they don't like to wear safety helmets not only because you don't look cool wearing one but it is really hot and wearing one only makes it worse.

A police cruiser shows up and most of the kids start running since you can get a ticket for not wearing a helmet but a few don't run away since they actually have respect for the law. They just stop riding and sit down since they feel they could not be cited since they were not seen riding the skateboards by the officer.

Well they were wrong, since they had boards and were in the park with them they were cited anyways. The reasoning was guilt by association, even though they were not witnessed by the officer riding the boards without helmets that since they were in the park with boards they had to have been riding them.

Now moving ahead to his day in court he was found guilty of the charge, fined $300.00 and was required to do 30 hours of community service. On top of that there is a fee to you must pay to do the community service so the actual fine is over $400.00.


Incident 2:

A couple unmarried but living together have had a pretty rough relationship, constantly fighting verbally and physically for many months up to a year. It is a back and forth situation sometimes she would hit him other times he would hit her. Most of this was not reported to the police but there had been calls made mostly by neighbors.

They have a business together and times had gotten tough so they lost their home and the business is going under. They were living in his motorhome on the business property and one evening they had been fighting when it escalated into a physical altercation. This time though it wasn't just one or the other punching someone the boyfriend actually pistol whipped her in the face, breaking her nose, lacerations, severe bruising and chipping some teeth.

She left bleeding profusely crying and screaming and went to the hospital to where the police were immediately summoned and a crime report was taken and signed by the girl. The police immediately went and arrested the boyfriend and hauled him off to jail where a few hours later he was bailed out of jail on $50,000. Of course he only had to come up with $5,000.00 through the bondsman.

Now moving to the court dates, he appears in court for the case filed against him and since the person that signed the complaint (girlfriend) didn't show the charges are dropped. Since they took pictures the district attorney immediately re-filed since the state can and does proceed without the victim.

Soon after the preliminary hearing takes place and another date is set for a mandatory settlement hearing. At this hearing they will try to keep things from going to court by getting the accused to plead guilty to a lesser charge. Oh the current charges are a felony and could land you in jail for a couple years, restitution and a pretty good fine.

So anyway, at this hearing you would expect the suggestion would be to for him to plea to the misdemeanor charge of spousal abuse since even though it is a lighter charge it still could land you in jail but more than likely you'll get probation, restitution, fined and some sort of anger management classes.

Well here's what this guy got today, Abusive/Loud Noise a misdemeanor, a $155.00 fine, no probation, no community service, no nothing.




It is unbelieveable that a kid riding his skateboard got fined and punished so harshly when in fact nobody was hurt even himself by not wearing the helmet and then someone can take the butt of a pistol whip his girlfriend with it and barely get a slap on the wrist. It is things like this that make a mockery of the U.S. justice system how in the world could something like this ever happen that an kid just not following the rules is punished worse than someone beating someone else?

What's even worse is I bet the D.A. knew it would end up this way with the beating and just wasted taxpayers money to pursue it. This is just another clear sign that our justice system sucks!

The cop might of saved the kids life or at least a serious injury. And other kids too.
As for the couple that likes to beat the hell out of each other. Who cares, they are both mentally handicapped if they stay in that situation. Nothing is keeping them there,together. Shes just as at fault for getting pistol whipped as his is for doing it.

I think you are missing the point here, sure the kid should be cited and maybe the fine is justified but only if a more serious crime meets with equal punishment. My way of seeing it is the beater should have been convicted of misdemeanor spousal abuse. We're not talking about a smack across the cheek here which I wouldn't condone either but someone beating her with a weapon. Nobody and I mean nobody has the right to hurt someone that badly. If it had gotten that heated someone should have just walked away. This stupid country has gotten way too much into protecting us from ourselves. Guess what I road bikes, skateboarded, rockclimbed, etc. etc. with no helmet as a boy and I survived. They tax cigarettes so heavily because they want people to quit, (I don't smoke) but government needs to get out of peoples personal lives. If I want to kill myself smoking a cigarette so be it. Now I'm getting off track here, the point is the punishment should fit the crime, do you think it is fair that someone is fined what amounts to almost $1,000.00 in fines and time for not wearing a helmet and someone that beats his gf only has to pay $155.00, seriously you can't believe that proper.

Ok you may of walked away. But they have a history of beating the :pokinit: out of each other right? At some point one of them is going to take it a step farther. Well, he got a 155$ ticket, it could of been her getting the ticket. You are missing the point. She beats him, he beats her. He just took it farther then a punch. There is no chain keeping her there. or a chain keeping him there. Either one can walk away at any time. So he pistol whipped her. I beat when he gets out, they go back to living together and fighting. The next time, and there will be one, she might take a gun and shoot him. AS for the kid with helmet, the cop had to do what the parents wont do. And thats be a parent. Protect your kids, teach them right. I see that as driving without your kids wearing seat belts. Ya we didnt wear helmets as kids, and some kids died. Adults died. Its proven they can help save lives, better late then never. And dont give me a line its be proven seat belts or helmets in certain situations would of killed someone. Its rare for that to happen.

Your problem lies in your assumption that...since you think, there is thinking involved in the actions of others.

Besides the federal government...the most pressing problem out country has, is legal reform.

Now I didn't say they were beating the :pokinit: out of each other, until he went the next step and did beat her face with a weapon, there was maybe a slap or the like not a beating.

The frequency or the intensity of their arguments is not the issue...he freaking beat her with a piece of metal! I would say that is assault with a deadly weapon!

He should be being butt bred by Bubba right now...not counting his change to pay his fine.

I'm not certain, but, I don't think tit for tat is a valid legal defense!

Youre right. But she should go to jail too. There should be a court/state issue stating that neither one of them can come in within 500 miles of each other too. Some one at some point will get killed.

Sure the chick is retarded for staying but wimmins do that sort of thing when they are mentally and physically beaten down over a long period of time.  They were both at fault but the guy needs to have his pulse removed.

Maybe that's part of what RS is talking about...if this went on for a year, maybe something should have been done. But look at it this way...you and I are neighbors, we argue all the time...maybe the police have even been called out. One time you punch me...the next time a take a freakin' chunk o' pipe to your head. NOW, are you going to think that's fair? No harm no foul? Are you going to insist on going to jail too!

As far a I know she never hit him with anything other than a slap, that does not warrant a beating with the butt of a pistol. Just the fact that it was a pistol leads me to believe it was close to being worse than what it was and our  government did nothing to curb the future possibilities. If he'd been convicted of spousal abuse he could no longer own a gun for 10 years thus possibly stopping a murder in the future. That is exactly what they did to the kid stopped future injury to him by giving a stiff penalty so that he will think about it when he is deciding to not wear the helmet.

To me, it doesn't matter if she ran over him with a Bobcat before (she should have gone to jail for that) he beat her in this instance!

The kids at that shot up columbine broke 22 gun laws!!!! you think anymore would of stopped them?  for all we know she hit him first. but if he hit her first and she slapped him, she should of left.  It sounds like they both fight, and he took it up a notch.

Oh I know, but he is known to carry so if he got caught he'd be off to jail. I understand more about that life style than you may think if you knew what I used to do.

Not to compare the 2 incidents, but just looking at the kids.............

Ding Ding Ding we have a winner!!! All this stupid law did was to teach kids to run from the law. Fortunately mine didn't and he got the ticket, but beyond that point here's a kid that has lived growing up around police officers and then started and was caught with F**k The Police slogans on his skateboards, backpack and his myspace page. So I asked him if he thought the same as so and so, of course he said no, I informed him that if he had been caught by our friend and he hadn't known him he would have been cited. The officer is doing his job, its a law and even if he thought it was a dumb law he was still required to do his job, but outside of work he's a person just like you and I.

So now what did the guy learn from the assault? That he can get away with assaulting her.

I used to ride BMX, back when public skateparks were starting to show up in every town, so I know firsthand this situation. It must have been in a nicer part of town. Go to the ghetto to ride if you want to get away with stuff, the cops there have to deal real crime, they don't have the time to harass good kids involved with a positive outlet. They smile and wave when they drive by the crappy hood skatepark, why because the kids in the park are not doing or selling drugs or in gangs.

The cops in nice areas are bored babysitters, especially in retirement areas! Too bad they don't realize what a negative image they give law enforcement when they harass good kids. Yes the cops should be enforcing the park rules but that can be done in a better way than what rocksurfer described. Thats a bummer that your kid got the shaft for not running. The best I can suggest is that you explain to him that there is a human factor to law enforcement, and that some cops do a better job than others. He just had the misfortune of running into a lame one, but to try to have faith that most cops are more fair than that.
