Well guys the judge made a order she is to return with the children to Vermont. They will be back in 2 weeks if she comply's with the order.
She is so lucky they didn't charge her with contempt of court she was infact in contempt.
I don't know why they didn't throw the book at her they should of in my opinion.
It's not like she was remorseful of what she did to me. She is more ticked off that she is ordered to come back here I think.
Well round one is over for now then in 30 days we will have another court date to determine the custodial parent.
The truth comes out I guess huh.

I'm happy at least things have gone good until this point. I hope things turn out at the next hearing.

Good luck man!  Just remember a cool head and honesty can help much more than emotions.  Let her be the one who starts going off in the courtroom and you'll have a better chance.

Also she is trying to appeal the judge's decision.

The judge didn't make a decision, yet. You have a court hearing in which the judge will make a decision but first you have to stand before the court. The only thing the attorney should be able to do for now is to represent her in this case.

i wish the best for you.... the courts system usually sides with the mother...... be prepared for a nasty fight, one that is going to tear up the kids.....

shes going to say she took them on vacation not a trip to aviod being serverd papers, and in her case "not knowing" or playing dumb about it, is going to get her far (although for your sake and the kids, hopefully it doesnt)

I am sure they will see right through her bull in court. I just hope you get your kids and that this hasn't confused them too much because I am sure she hasn't been saying good things about you lately because she's probably a bit frustrated or scared, but what she did was TOTALLY uncalled for!

Sometimes judges get so used to wallowing in :pokinit: day in and day out that they can't see through it anymore.  A lot of them seem to think the mother is the only choice for custody, since she actually went through the birth and has that bond.  Pish posh man, the more responsable of the two, both physically and financially, should be the one to have custody, period.  Once again, good luck man, I hope you get one of the few decent judges.

I hope it all works out, but there have been times that the judicial system sucks!  A co-worker's ex wife had custody of their 3 boys and even though the system knows she's a well known drug user they still granted her custody, even when she over dosed on meth in front of the kids, the courts still stood behind her!  Good luck and just play it cool in court!

Her appeal was denyed. She has to come back today by 5:30 pm and return my children.
If she isn't back by that time I call the police then it becomes a criminal matter.

Yup the kids are back I spent the last 3 days with my kids it was great. I loved every minute I spent with them.
I got a barrage of phone calls from her family 13 calls in 3 days is excessive plus her roomate Pam in laguna nigiel kept trying to call and talk to the kids. I told my step father no way she isn't related to my children I don't want her talking to them. She got nasty with my mom on the phone threating to call DiAnne's lawyer. She has the children calling her Auntie Pam.
The living situation isn't what she said it was she made it out to the court like it was a 3 bedroom it is actually a 2 bedroom my kids are sleeping all in one room and DiAnne and her roomate Pam share a bed.
I found this out from my 6 year old son who told me about his room and the living situation.
A little TMI for me I don't even want to go there thinking about things it kinda turns my stomach. I maybe wrong about it all but something just ain't right about that. Also I reenrolled my son Noah into school but DiAnne keeps going there to school to hang out after I drop them off on the days I have my kids. All i can think is she is that insecure about things she has to do that to feel good. Pretty sad if you ask me.
Anyways that's what's up with me.
