it has an ARB in it could that have anything to do with it??

Seals in the ARB could go, and that would pressurize the diff and push oil up the breather.  You would probably also notice some lag in it locking up.  When my rear ARB did this it usually wouldn't lock til I'd rolled around a few miles and heated up the diff to a running temp.
