how come it hasnt been smogged yet? wont pass or?

its been in my family for six years. my brother bought it and it passed , then he had work on it the timing belt may be put on wrong causing the timing to be off, we've had it smogged before but it wouldnt pass, i dont have the time to put into getting a new one in there. i think thats why it wont pass smog, you can tell the timing is off cuz you can hear it "puttering" when it idles but as soon as your driving it drives fine.
