I read that last night, too. Sounds like a very gullible kid got owned by a manipulative little very *friendly* person, and the guy is paying for the fact that he was thinking with the wrong head! He believed everything she told him, without proof, and got in the middle of something that he should have run from as fast as he could. I have seen too many young girls like her to believe any of that kind of crap without evidence. I guess everyone has to learn, one way or another.

i think page 9  is where it came out he was  going up for statutory rape

I'm in no way defending him. As an adult, he should have respected the wishes of her parents, whether he agreed with them or not. He screwed up, and didn't do what was best for him, and he's now paying for it. She was not HIS daughter, so he had no authority in any case.

If there WAS a problem (abuse, and more than "she said"), he should have reported it, then stayed away. And, statutory rape is a term that covers a very WIDE range of situations. It is impossible to take any sides without definite information. Most of the responders were immediately treating him like a child raper without having the facts. This is how an unfortunate situation gets blown out of proportion and ruins people for life.

My question about this situation: Is the girl innocent of everything? was she telling the truth about her situation? or was she trying to get attention and sympathy? and was she still trying to see him after he was told to stay away? why is it that she cannot be held accountable for HER actions? (It takes 2 to tango)

My suggestion to all of this, is not to jump to conclusions before you get the facts.

I finally got done reading everything.  Including all the links.  We was definitely not smart about anything.  He was getting banned from just about any site he was on.  A very stupid young boy!

So the "cliff notes" version (13 pages is waaaay too long of a read) is he is going to state prison for two years on a statutory rape?

FYI: Here is a portion of CA Penal Code 261.5 (statutory rape)

§ 261.5.  Unlawful sexual intercourse with a minor; Misdemeanor or felony violation

(a) Unlawful sexual intercourse is an act of sexual intercourse accomplished with a person who is not the spouse of the perpetrator, if the person is a minor. For the purposes of this section, a "minor" is a person under the age of 18 years and an "adult" is a person who is at least 18 years of age.

(b) Any person who engages in an act of unlawful sexual intercourse with a minor who is not more than three years older or three years younger than the perpetrator, is guilty of a misdemeanor.

(c) Any person who engages in an act of unlawful sexual intercourse with a minor who is more than three years younger than the perpetrator is guilty of either a misdemeanor or a felony, and shall be punished by imprisonment in a county jail not exceeding one year, or by imprisonment in the state prison.

(d) Any person 21 years of age or older who engages in an act of unlawful sexual intercourse with a minor who is under 16 years of age is guilty of either a misdemeanor or a felony, and shall be punished by imprisonment in a county jail not exceeding one year, or by imprisonment in the state prison for two, three, or four years.

My guess is "Fonz" falls under "(d)." He is over 21 and she is under 16 (but not under 14). He will do 50% of the 2 years with any credits he accumulated while he was in the county jail.
